Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the CoTrips website and services, including any content, functionality, and services offered on or through cotrips.ai ("the Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

Subscription and Payments

CoTrips offers various subscription plans with different features and credit allocations. By subscribing, you agree to pay the applicable fees specified at the time of purchase.

Unless otherwise stated, subscriptions are automatically renewed at the end of each billing period. You can cancel your subscription at any time through your account settings or by contacting our support team. Cancellations will take effect at the end of your current billing period.

Credits are non-transferable, have no cash value, and expire as specified in the plan details. Unused credits do not roll over between billing periods unless explicitly stated in your plan.

Payment Processing

We use Stripe as our payment processor. By subscribing to our Service, you agree to:

• Provide accurate and complete payment information
• Authorize us to charge your chosen payment method for subscriptions and any additional purchases
• Keep your payment information updated to prevent service interruptions
• Review and adhere to Stripe's terms of service and privacy policy when using their payment services

Billing and Renewal

Your subscription will automatically renew unless you cancel it or we terminate it. For monthly plans, you'll be billed on the same day each month. For annual plans, you'll be billed on the anniversary of your subscription start date.

We'll send an email receipt for each payment processed. If we're unable to process a payment due to expired credit cards, insufficient funds, or other reasons, you'll be notified and your account may be downgraded or suspended until payment is received.

Price Changes and Promotions

We reserve the right to modify our subscription prices at any time. If we change pricing for existing subscription plans, we'll notify you by email at least 15 days before the change takes effect.

Promotional offers and discounts are subject to specific terms, including time limitations and eligibility requirements. Unless otherwise specified, promotions cannot be combined with other offers.

Refunds

All purchases are final and non-refundable unless otherwise specified or required by law. In exceptional circumstances, we may, at our sole discretion, issue partial or full refunds if technical issues prevent you from accessing our services.

For subscription cancellations, you'll retain access to your plan features until the end of your current billing period, but no refunds will be provided for the unused portion of your subscription.

AI-Generated Content and Disclaimer

CoTrips uses artificial intelligence to generate travel itineraries and recommendations based on your inputs and preferences. You understand and acknowledge that:

• All itineraries, suggestions, and travel recommendations are computer-generated and have not been individually verified by human travel experts
• AI-generated content may contain inaccuracies, errors, or outdated information about destinations, attractions, pricing, or travel requirements
• Travel conditions, local regulations, opening hours, and availability may change without notice and may not be reflected in our generated plans
• We do not guarantee the accuracy, completeness, suitability, or safety of any AI-generated travel recommendations

User Responsibility

By using CoTrips, you explicitly agree that:

• You are responsible for verifying all information in your travel itinerary before making any travel arrangements or decisions
• You will conduct your own research regarding travel requirements, visas, safety conditions, health precautions, and local regulations
• You will confirm the availability, pricing, and details of all accommodations, attractions, and activities before booking
• You will exercise reasonable caution and judgment when following any suggestions in your itinerary
• You assume all risks associated with your travel plans and decisions

Limitation of Liability

CoTrips is not liable for any losses, damages, accidents, injuries, or inconveniences that may arise from:

• Inaccurate or incomplete information in AI-generated itineraries
• Changes to travel conditions that occur after an itinerary is generated
• Any travel decisions or actions you take based on our recommendations
• Unforeseen circumstances, cancellations, or changes to your travel plans
• Personal safety incidents or health issues that occur during your travels

Our AI travel planning tool is provided as an informational and inspirational resource only. The final decision and responsibility for all travel arrangements and activities rest solely with you, the user.

User Responsibilities

When using our Service, you agree to:

• Comply with all applicable laws and regulations
• Provide accurate information when creating travel plans
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to deceive, defraud, or mislead us or other users
• Not interfere with or disrupt the Service or servers connected to the Service
• Not reverse engineer or attempt to extract the source code of our software

Intellectual Property

The Service and its original content, features, and functionality are owned by CoTrips and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your itineraries and personal travel plans are your content. You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process this content solely for the purpose of providing and improving the Service.

Limitations and Disclaimers

CoTrips is a travel planning tool, not a travel agency, tour operator, or booking service. We do not:

• Book accommodations, transportation, or activities
• Guarantee availability, prices, or quality of recommended places
• Provide travel insurance or handle travel emergencies
• Verify visa requirements or travel restrictions

Our Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free or uninterrupted.

Limitation of Liability

To the maximum extent permitted by law, CoTrips shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to your access to or use of, or inability to access or use, the Service.

This includes damages related to travel disruptions, changes in travel plans, or actions taken based on information provided by our Service.

Indemnification

You agree to indemnify, defend, and hold harmless CoTrips and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or violation of these Terms.

Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding relating to your access to or use of the Service shall be instituted in federal or state courts located in Delaware.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
